According to the Hong Kong Patents Ordinance and the Registered Looks Ordinance, Hong Kong patents are divided into standard patents, short-term patents and design patents.

A standard patent is a patent that has been examined and authorized by a designated Patent Office and has been registered and granted in Hong Kong. The designated patent offices are the Chinese Patent Office, the UK Patent Office and the European Patent Office (designated UK).

There are two steps to obtain a standard patent, first of all, the applicant should apply for his invention to the designated Patent Office, and within 6 months after the application is made public by the designated Patent Office, the application should be recorded in the Hong Kong Intellectual Property Department Registry, which will record and publish it after formal examination. Secondly, the application should apply to the Intellectual Property Department for registration and authorization within 6 months after the patent has been granted or the record application has been made public, and the Registry will approve the registration and grant the Hong Kong Standard Patent for publication after formal examination.

Short-term patent applications are processed directly by the Intellectual Property Department Registry. Short-term patents and design patents are not subject to substantive examination, but only to formal examination, and if they pass the examination, patent rights will be granted. However, when submitting a short-term patent application, the applicant shall also submit a search report made by the prescribed search agency for the patent.

A standard patent may be renewed once a year after the expiration of the third year for a period of up to 20 years (from the date of application at the designated Patent Office). Short-term patents can be renewed four years from the filing date of the application and are valid for up to eight years (from the filing date or priority date). The initial period of validity of the design is 5 years from the date of submission of the application for registration, and may be renewed for 5 years at a time thereafter, for a total period of validity not exceeding 25 years.
